    notld license

    just wondering as notld is a public licence does that mean a game based off it wouldnt need licencing from anyone..... just wondering.

    you could make a game without a license since it is in the public domain.

    The problem with being able to make anything you want with "Night" being public is you can't protect it in any way. So if you make a cool toy that starts to sell, ANYONE can make that exact same toy.

    no - you own that particular incarnation. the original is in the public domain, but what you create from that is not - it is still protected by copyright laws. look at the bible. the story of christ's crucifixion is in the public domain - anyone can make a story or products from that. mel gibson made the passion of the christ which is protected by copyright laws. even though the original story is in the public domain, mel gibson's film of this story is not.

    Thats all great and good but has nothing to do with what we are talking about (Well it does but not they way you are thinking). 'NIGHT' is free and in the public domain and anything based off of it is free and clear. Hence why the reason you also see a billion Bible stories and products out there.

    So if you make a Barbara action figure based on the woman from the film there is no reason I couldn't make it and sell it too. I'm basing mine off an unprotected source.... so are you. You have no claim on a barbara action figure because the source is FREE. I'm not selling your exact figure I'm making my own version of the exact same thing... why? Because you can't own the rights to make a certain toy on something no one has the rights to.

    that is not what i said: yes, if you want to also make a barbara figure you are free to, but you cannot take my version and resell it as your version. that is copyright infringement. you are free to take anything from the public domain source, but once you do and manufacture or create it, it is yours and protected by international copyright...(you should re-read what i wrote...)

    Uhhh okay then you should re-read my first post. we're arguing semantics here. take away EXACT from my first post and change it with ALMOST exact. How's that?

    Either way you can't make a unique "Night" product like you could say with a "Superman License".

    i didn't argue against that. in the sense that you can't make a unique product (like only you can produce toys, or someone else a videogame, exclusively) yes - but in the sense that your own unique version of that product, yes you CAN. YOUR own work is still protected by copyright, even if the source isn't. so, we are both right...just your semantics gave the wrong impression...
