I know this has been discussed in great length before, but I always seem to forget. So Night of the living dead really has no real copy right protection on it, anybody could really make their own version of it without being sued right? hence the Night of the living de3d remake i guess

As far as I know, yes indeed, there is no copyright on Night at all, which surely must be the case as recently GAR was talking about Diary and briefly made mention of seeking to secure copyright on a new property for a change. Indeed, it is a confused issue, but Night is a public domain film.

You can do a remake of it, and you can distribute a DVD of it if you find a film print without the copyright notice on it. You can also have a presentation of said right-less film print, and charge money.

What about Night of the Living Dead 1990, wasn't that done in part to renew the copyright?

It was an attempt to renew the copyright, but it didn't work. GAR has said the same thing of Diary - I don't think to regain copyright of Night, but to gain copyright over a dead movie...
