I just think that story is too funny but I do feel like he has a bit of a case... even if its sorta his fault that he got caught lol

Well, they did breach the contract, didn't they? He should sue them for breaching their contract, not for the divorce.

Though I agree that the breach of contract is likely actionable, I got to say that this guy sounds like a dimwit. What kind of idiot has an affair and then charges roses (or anything affair related) to his credit card and expects to get away with it? He deserves whatever wrath his wife lays on him.

Its too funny that he got caught but he does IMO have a case that's prolly winnable against 1800flowers since they did technically breach their contract ... I would even go so far as to say they should be liable for any extra damages that his ex is awarded in the divorce for the affair because its possible that were it not for their breaching of his contract with them she may never have found out. The question is... does cheating on your wife give you unclean hands? Because if so they may not be liable in any way for his divorce settlement increase...

I don't know where he gets the sum of 1 million from. 300 000 is what the divorce cost him, but US lawsuits always seem to be adding a few zeroes at the end just to satisfy their greed.
